Access to and use of AirPhysio site is provided by the operators of this website (AirPhysio Pty Ltd ABN 84 607 523 697 (“us”, “we” or “our”) on the following conditions and according to any other directions or rules of use on this site (“Terms”).

If you access this site (other than to read these Terms for the first time), you agree to these Terms. If you do not agree to these terms, you should not review information or obtain services or goods from this site.

We reserve the right to change these Terms, our Privacy Policy and any content on our website (including, but not limited to any distribution fees, other fees and prices and the terms of any payment) at any time by posting changes on-line. You are responsible for informing yourself of any changes by regularly reviewing these pages. If you access the site after changes are posted, you agree to all changes (including those which you are then unaware have been posted).

Continued site availability and access 

We do not warrant that we will continue to make this site available generally or at all and reserve the right at any time to impose or increase prices and fees for your future access to any material appearing on this site. We reserve the right at any time to alter the site in such a way as to change the equipment needed by you to access or use the site or any part of it.

Limitation of our liability (if any) to you 

Our total liability to you (if any) for loss, damage or reliance shall be limited, at our election, to:

  • In the case of information, product or services supplied or offered by us – the re-supply of the information, product or services or payment of the cost of doing this;
  • In the case of products supplied or offered by us – repair or replacement of the products, supply of equivalent products, or payment of the cost of doing this; or
  • The amount paid by you (if any) for accessing this site.

Indemnity 

You indemnify us, our affiliates, distributors and our respective employees, agents, third party content providers and licensors from and against all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) incurred or suffered by you or by us as a direct or indirect consequence of:

  • Your accessing, using or transacting on this site or your attempts to do so (except for our costs of making this site available to you that you have not agreed to meet);
  • Any breach by you or your agents of the Terms.

Rights we cannot exclude, limit or disclaim

This disclaimer, liability limitation and indemnity does not exclude any rights which by law may not be excluded.

  1. PAYMENTS All payments required to be made from a transaction in connection with AirPhysio website will be GST inclusive and will be made at the prices published on the Website and paid in the manner published on the AirPhysio website.

2. Pricing, Return, Refund and Exchange Policy

Pricing Changes

Changes in pricing for the service and product may be communicated by means including posting on the Site or via email. You will pay all sums due to the Company under this agreement by the means specified in the billing section of the Site. Payment will be transacted without any deduction, counterclaim or any other withholding of payment. Payment shall be deemed to have not been made until the Company has cleared funds in respect of the full amount outstanding.

Refund and Exchange Policy

Return Instructions for Purchases

If something isn’t right with the operation of the device, or the device doesn’t work for you, we are happy to accept a return within 30 days of purchase, subject to the Refund and Exchange Policy at the bottom of this page.

Return Instructions for Online Purchases

Items purchased online can be returned by post or to a store which stocks the same brand for a refund. We can also exchange items in store, but cannot do exchanges via post.

Please refer to the Refund and Exchange Policy at the bottom of this page to ensure your return meets the requirements.

HOW TO RETURN AN ONLINE ORDER VIA POST

  1. Visit http://www.airphysio.com/NaturallyBetterBreathing/contacts/.
  2. Complete the contact formwith your details and reason for return and we will be in contact with you.
  3. Pack the item(s) for return. Put the postage label on the front.
  4. Once we receive the package and confirm that it meets our returns policy, we’ll process your refund and send you an email to let you know. The refund will appear in your back account in about 3-5 days after you hear from us. If there are any issues or your return doesn’t meet our policy, we’ll contact you and send your parcel back to you.

HOW TO RETURN AN ONLINE ORDER IN STORE

  1. Drop in to a store. Take your item(s) to an AirPhysio reseller store which stocks the brand of item you’d like to return.
  2. Provide proof of purchase. You must provide the packaging slip included in your order and the tax invoice we emailed to you.
  3. Once the return and exchange policy has been met, we’ll offer you a refund or an exchange in store, on the spot.

RETURN INSTRUCTIONS FOR IN-STORE PURCHASES

Items purchased in store can be returned to a store which stocks the same brand for a refund or exchange. Please note that items purchased in store can’t be returned by post.

Please refer to the Refund and Exchange Policy at the bottom of this page to ensure your return meets the requirements.

  1. Drop in to a store. Take your item(s) to an AirPhysio reseller store which stocks the brand of item you’d like to return.
  2. Provide proof of purchase. You must provide proof of purchase.
  3. Once the return and exchange policy has been met, we’ll offer you a refund or an exchange in store, on the spot.

OUR RETURN AND EXCHANGE POLICY

GENERAL

  • Items purchased on-line can only be via post and not returned in-store.
  • Items purchased in-store must be returned in-store and not via post.
  • Shipping costs will not be refunded if there are other items listed on the original invoice that are not being returned.
  • Products can only be returned to a AirPhysio reseller store which stocks the brand of the product you wish to return.

CHANGE OF MIND

If you change your mind about the products you have purchased from us, we will refund the purchase price or exchange those products in the country in which they were purchased subject to the following conditions:

  1. Item(s) must be returned within 30 days of purchase, together with proof of purchase.
  2. Item(s) must be unused and still in the original packaging with all original tags/labels attached.

If you request a refund, the purchase price (excluding delivery charges for online) will be refunded to you using the original payment method once we have received the returned item back and confirmed that it meets conditions 1 and 2 above. You are responsible for any costs associated with returning the item to us including any currency conversion and/or local or international taxes.

FAULTY PRODUCT

If an item is faulty, wrongly described, or different from the sample shown then we will meet our legal obligation which may include refunding the purchase price and delivery charges, or providing a replacement product provided the item is returned within a reasonable time with proof of purchase.

Your personal information will be used according to our Privacy Policy to process your refund or return.

OUR SOCIAL EXCHANGE POLICY

AirPhysio recommends that the AirPhysio respiratory device be exchanged every 6 months from date of purchase. This is to maintains the highest effectiveness and hygiene of the device.

We are committed to ensuring that everyone, irrespective of their financial circumstances, can improve their health through better breathing, reduced impact of pollution and improved lung function.

As a part of our commitment to this vision, AirPhysio offers a ‘customer exchange’ program for its devices. After 6 months of usage, simply return your AirPhysio to our registered distributor in the country and we will:

  • Replace your AirPhysio device at 50% of the RRP to ensure your continued benefit from using AirPhysio.
  • AirPhysio will then Sterilise and Refurbish your returned device and send to an appropriate agency operating in one of many countries with underprivileged people, who are in need of these devices.

If you choose to change your method of payment you must inform AirPhysio about your intention to change your payment method and this must be approved by the accounts department before the date that the next payment is due.

Delivery and Shipping Policy

AirPhysio prices including shipping to anywhere in the world. Products are produced and shipped directly from Australia, so depending on your location, it may up to 1 week in Australia for delivery.

  1. AFFILIATE AND DISTRIBUTION PROGRAM 

    These Terms, our Privacy Policy, the ‘Affiliate and Distribution Program’ published on the AirPhysio website and the ‘Affiliate and Distribution Terms and Conditions’ apply to all parties appointed by us as ‘Affiliates and/or Dirstributors’.
